A murder case against ANC member of parliament Sibusiso Kula was postponed due to a dysfunctional stenographer to record the proceedings.
On Monday, April 17th 2023, the Orkney magistrates court postponed a murder case against the ANC member of Parliament Sibusiso Kula to April 26th 2023, due to a dysfunctional stenographer. This hindrance has made it impossible to record the proceedings and for the accused attorney to present an application to oppose further postponement.
Sibusiso Kula is currently out on fifty thousand rands bail granted by the North West High Court two weeks ago. This is after his appeal at the Orkney Magistrates’ Court. The court told the publication that they could only afford to postpone the matter for a while as they wanted it to be concluded.
Sibusiso Kula was quoted as saying that his view is that in his culture of Isixhosa , he is still mourning and must be given the necessary space to grieve for his wife and need to recollect and arrange his life, and also can’t wait for the day when the matter resolved and that I’m a free man .".
He said the community is accepting him well since his release on bail .”There’s never been an issue since I’m out, those who were here protesting are not even here today because lies have got short legs, but we'll demonstrate in due course that ayikho lonto ethethwayo (there’s no such).”he said.
Sibusiso Kula has three daughters aged eleven, nine and one year eight months. One of his bail conditions is that he is not supposed to have direct or indirect contact with his children. Kula has said that as a law-abiding citizen, he can do nothing if the high court has reached that decision. "Once the matter is put to rest, I will fix my relationship with my children because ndibathanda nge ntliziyo yam yonke (I love them with all my heart) and those feelings will not change. I will fight this matter, not for me but for them. They've lost a mother and can't afford to lose a father. They need me in their life, I’ll fight to ensure that there’s sanity and we reconnect that relationship. ”he said.
Regarding his political career, Kula said he will continue to be a parliament member as elected from May 24th 2019, to May 24th 2024.
Gcina Dlanjwa, the attorney representing the parliament member, said they are very confident about the case and added that the high court is one of their grounds. Gcina says the state is unsure about its case against his client .”You must remember that Mr Kula does not have to prove anything. They have to prove beyond reasonable doubt that Mr Kula is guilty of the alleged offence.” he said.
He further stated that the postponements, in this case, certainly delay tactics.
Sibusiso Kula was arrested on Friday, January 20th 2023 and charged with murder after his wife, Jennifer Mohlomi, was found murdered at their home on November 27th 2022, in what seemed like a robbery. She was found with a stab wound on her back, but the police never recovered the object used for her alleged murder.
