President Ramaphosa appoints Advocate Gcaleka as Public Protector

In a significant and pivotal move for upholding the principles of justice and accountability in South Africa, President Cyril Ramaphosa has appointed Advocate Nompilo Kholeka Gcaleka as the country's new Public Protector. This decision, made in accordance with section 193(4) of the Constitution of the Republic of South Africa and following the recommendation of the National Assembly, signifies a fresh chapter in the nation's pursuit of good governance and safeguarding the rights of its citizens.

Adv. Gcaleka is the former deputy Public Protector. Gcaleka’s appointment marks the beginning of a non-renewable seven-year term, starting on November 1, 2023. With a wealth of experience and a strong legal background, Ramaphosa expressed his confidence in Gcaleka's abilities to fulfill the demanding responsibilities of the Public Protector's role.

Ramaphosa's extended his well wishes, emphasizing the importance of her commitment to serving the people of South Africa with unwavering dedication and integrity. Gcaleka follows on the footsteps of the fired Advocate Busisiwe Mkhwebane after the Judicial Service Commission (JSC) found her to be unfit to uphold the office.

Mkhwebane has since become a member of the Economic Freedom Fighters (EFF). The position of the Public Protector is fundamental in the South African governmental system, tasked with acting as a guardian of the public interest and ensuring transparency and accountability within state institutions. The role holds various significant duties, some of which encompass:

1. Safeguarding Constitutional Principles: The Public Protector is entrusted with upholding the principles enshrined in the Constitution, ensuring that state organs and officials function in a manner that respects the rule of law and protects the rights of the public.

2. Investigating Misconduct and Maladministration: Advocate Gcaleka will lead investigations into alleged misconduct, improper conduct, maladministration, and any violation or abuse of power within state entities, ensuring fair and just outcomes.

3. Empowering Citizenry: Facilitating public access to information, empowering citizens to engage with governmental processes, and advocating for the enhancement of governmental accountability are crucial aspects of the Public Protector's duties.

Her appointment was not without controversy, with the two biggest opposition parties, the Democratic Alliance and the EFF calling her nomination "nonsensical". The DA and the EFF rejected Gcaleka's nomination, saying she was not a suitable candidate and has a cloud hanging over her head. They were unhappy with her appointment, stemming from her Phala Phala investigations, where they say her report was a whitewash.
