Kula murder case progresses as witness list is revealed

The ANC Member of Parliament Sibusiso Kula (34), who is facing a murder case against his wife Jennifer Mohlomi, made a brief appearance before the Orkney Magistrates Court on Wednesday, September 6, where he was provided with a list of 19 witnesses. When he was granted bail by the High Court of South Africa, North West Division, in April, the High Court ordered the state to provide Kula and his attorney, Gcina Dlanjwa, with a list of witnesses in April, but the state failed to do so for the past five months.

Kula's attorney, Gcina Dlanjwa, said the list consists of initials and is not sufficient for them, and they request to be given a proper list with full names because the list with initials is far from what the High Court has ordered the state to provide them with. Dlanjwa further said they are unhappy about the postponement of the case, which indicates that the state is aware that they do not have a case against his client. "We are intending to bring again an application that this matter should be struck off the roll on the next court appearance because the state has never been ready about its case against my client," he said.

The State Prosecutor, Kelebogile Seloma, said the state requested that the matter be postponed for instructions from the Director of Public Prosecutions (DPP) in the North West, indicating that at this point, the state is unable to elaborate further as to how far the investigations are because the state is not in the docket.

Following thorough investigations by the police, Kula, currently out on R50 000 bail, was linked to the alleged murder of his wife, Jennifer Mohlomi, who was found murdered at her home on November 27, 2022, in what seemed like a robbery. Kula was arrested on January 20 of this year and charged with murder. On Wednesday, September 6, his case was postponed by the Orkney Magistrates Court to October 13 for further investigations and a Section 342A inquiry.
